With Kavanaugh in? How would something like that go through the courts? Can they just keep appealing until they get their friendly Supreme Court? Because that particular case is so precedent-setting and unusual, I do believe the Supreme Court would take the case. I'd expect we'd probably lose 5 - 4 but I suppose we could hope for a 5 - 4 victory.

However, keep in mind that the Supreme Court does not take a large number of cases. It is something like 70 to 80 cases per year. They take cases where different federal courts have disagreed or are for other reasons important cases.
