"That's a terrible appointment. Whitaker is a stooge for the White House who was appointed to kneecap the investigation; he's so far out of the legal mainstream that he doesn't even accept Marbury v. Madison; and anyhow I should have been given the job!"?

If he'd said something like that, right now Rosenstein would be standing at the curb in front of a DoJ office building, holding a cardboard box containing his desk calendar, a potted plant and some purloined ballpoints, waiting for a cab in the rain.

Or he's an idiot, and doesn't realize that unlike him, Whitaker hasn't been passed by the Senate, and probably couldn't survive a Senate hearing, given his ethical issues.

Was he going to throw himself in front of a cabinet containing copies of the Mueller files and yell "You'll take away these files when you pry them from my cold dead hands!"? Whitaker is now his boss unless/until something happens to make him step down.

As perverse as it might be for someone who puts in years at the DOJ to be subservient to a Johnny come lately partisan hack, that’s the reality here.

And I suppose Rosenstein could just go ahead and call him a hack, and likely get fired for insubordination, but I guess that’s not how he wants to play it, he wants to be a mensch, so what else can you say?
