Supreme Court will not hear lower court case which affirms the right of Medicaid users to use Planned Parenthood's non abortion services. Federal funds have been prohibited from being used for abortion since the Hyde Amendment.

(9,726 posts)WASHINGTON The Supreme Court refused Monday to consider efforts by Republican-led states to defund Planned Parenthood. Despite its new, more conservative tilt, the court let stand federal appeals court rulings that allowed the reproductive health organization to contest laws in Louisiana and Kansas that stripped its Medicaid funds.
The courts refusal to hear the case represents a setback for conservative interest groups in many states that have sought aggressive action against Planned Parenthood and abortion providers in general. Notably, Chief Justice John Roberts and new Associate Justice Brett Kavanaugh did not join the dissent. Three of the court's conservatives Associate Justices Clarence Thomas, Samuel Alito and Neil Gorsuch dissented and said the court should have taken up the issue.
"What explains the courts refusal to do its job here?" Thomas wrote. "I suspect it has something to do with the fact that some respondents in these cases are named 'Planned Parenthood.' That makes the courts decision particularly troubling, as the question presented has nothing to do with abortion."

I have my disagreements with Roberts, but I suspect that as a defender of the court as an institution, he will have few equals (and I can respect that).
He won't be the next Souter, but even if he's in the same ballpark, I'll take it

(81,194 posts)Remember, its called The Roberts Court. Thats how its referred to, in coverage and in books - including history books. Hes the Chief Justice. So its labeled with his name as long as he stays in that job. He may be one of those players who has a sense of history and the part his position decrees he must play in it. Accordingly, predecessor Chief Justice, William Rehnquist, ran whats known as the Rehnquist Court.
Therefore, John Roberts may be highly conscious, maybe even painfully conscious, of what history will say about him.
Id want to sit on the new wise ass too. FIRMLY sit on him. And stay glued there, indefinitely. To save him from himself and to save the respectability and credibility of the Supreme Court era that bears his (Roberts) name.

(27,800 posts)There was a long article in the New York Times magazine a few months ago about everything the Reagan administration did (or didn't do) that ultimately caused great harm to the environment, and front and center was Anne Gorsuch, Neil Gorsuch's mother, who was appointed the head of the EPA, but had the full intent to gut the agency. It should have been a huge issue when they had hearings for him.

(11,541 posts)Kavanaugh, no doubt, saw this vote as a step toward repairing his tattered reputation. Nevertheless, think of the countless lives that will be saved by continuing funding for the Planned Parenthood clinics.

(6,137 posts)will be ruling differently as SC justice vs. his prior decisions. He can repair the trust by siding with ginsburg in key cases especially casea involving women and minorities. Gorsuch already proved he is just another thomas with no independent thinking but kavanaugh promised collins not to overurn roe v wade; Roberts has said on multiple ocassions that roe v wade is a setted law so I dont see him completely ignoring decades of precedent especially in metoo era. His vote in ACA case was in conflict with federalist society indicating that his ability of independent thinking which thomas, alito and gorsuch are not capable of. One of the bigger challenges is gun control where the precedent is againts us.

But, the 8th U.S. Circuit Court of Appeals decision to allow Arkansas to block Medicaid patients from accessing care at Planned Parenthood still stands. (Arkansas, Iowa, Minnesota, Missouri, Nebraska, North Dakota and South Dakota.) (No)
And remember... It's not a ruling, it's a refusal to hear. They can always change their minds
