1. O'Donnell argued that treason can only occur with "declared war".

What happens when a nation just buries its head in the sand? We were under cyber attack.
The old idea of war is obsolete. Putin knows it.

7. I've read the case law O'Donnell referenced.

I am less sure than he that a "declared war" is a condition precedent.

However, I think the question unnecessary. We can get where we need to go with more conventional charges.

10. He was only reading the first situation that could be treason.

He didn't go past the or in the section.

Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort.

6. Some still insist an enemy can only be the object of a declared war. This is just plain obsolete.

That's also why there are so many problems with an unabridged 2nd amendment.

9. I just rechecked the Constitution and I disagree with O'Donnell

Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort.

It fails on the first part. But fits the second part for treason.
