Avenatti Pocketed Over $30k From His PAC Which Spent $0 On Behalf Of Any Candidate In 2018

Some time ago on DU, after a number of DUers had indicated they were donating, the question arose as to whether Avenatti could pay himself out of the funds for "The Fight" PAC which he had started last year.

I took a look at the overall financials filed with the FEC for the 2018 year-end, and noted that his PAC managed to rack up a variety of travel and dining expenses while contributing absolutely nothing either directly or as independent expenditures on behalf of any candidate for office whatsoever. A good chunk of the expenses were for (a) advertising the PAC itself and (b) travel and dining.

He took in and spent over $100k and is down to a little over $10k, so those of you who donated before might want to pull out your wallets and shovel some more cash in, because baby needs new shoes.

What I failed to notice, since I didn't look at all the detailed expenses was that despite failing to provide material support to a single candidate in any race anywhere in an election here, more than $30,000 - roughly a third of what the PAC spent - did go to a particular individual:



There is no explanation in the FEC filings as to what, precisely, these payments to himself were for.

It seems that it was also in October that more financial poop started hitting Avenatti's fan:

In October, a California judge ordered him to pay a former partner, Jason Frank, $4.85 million — a sum that has still not been paid, according to Frank’s attorney Eric George. That same day, court documents showed his firm, Eagan Avenatti, was evicted from its office in a Newport Beach building for allegedly failing to pay rent for the past four months. (Avenatti says he is no longer associated with the firm.)

In fact, if you drill down on the PAC debit notes, several of the "travel/dining" expenses go into his IOLTA account. He's been playing a shell game with a variety of different bank accounts and payment sources to evade his judgment creditor.

It will be interesting to see what Avenatti chooses as a career after he loses his license. I suppose he'll write a book.

And I think Ms. Miniutti is not happy about the idea of having to answer questions under oath over those payments.

He put her in a bad situation.

Probably over-dramatic. But it was extended on January 23.

Since TMZ and Jacob Wohl were laying down smokescreen for Avenatti, the real story got pretty much buried. They were having an argument over her payments, which became heated.

By itself, it's a nothing-berder. In the context of a rabid judgment creditor hot on the trail of finding out that Avenatti was concealing bank accounts and personal payments, then there's a little bit more to whatever it was they were arguing about, and why she would want to make sure he leaves her alone.

Because in order to justify paying her out of funds in an undisclosed attorney/client trust account, he'd need her to cooperate with whatever story he proposed that she provide for why on earth she was getting thousands of dollars a pop out of a bank account which is supposed to be holding client funds.

Restraining orders are becoming a regular feature of Avenatti's life, since he picked up another one this week:

A large quantity of documents has come out in the former partner suit, showing the mechanisms Avenatti used attorney trust accounts to hide personal money from creditors and clients, in which he commingled personal and client funds. Among other things, he was using an account that received settlement money from an opposing party on behalf of a client of his, to pay his girlfriend - the one who got the restraining order against him after the argument over money. It turns out that some of the PAC money was going into an attorney trust account which he had not identified to the bankruptcy court, so that he could pay various personal expenses while keeping the court and his creditors in the dark.

It's a pathetic and sleazy picture which is blowing up in his face.

Documents filed in Frank’s case appear to show multiple payments to Miniutti totaling $33,000 from March to October 2018. One Eagan Avenatti attorney-client trust account paid Miniutti $8,000 on March 23, $4,000 on April 12, and $1,500 on Oct. 16, bank records appear to show.

A client-trust account, opened under “Michael Avenatti, Esq.” paid Miniutti a total of $14,500 across five transactions in June and July. An operating account, also opened under Avenatti’s name, paid Miniutti $5,000 on May 24.

Miniutti could not be reached for comment. Her attorney, Michael Bachner, told The Daily Beast, “To extent that Mareli received money from Mr. Avenatti, her assumption was that she was receiving it from him in his individual capacity.”


Asked about the payments, Avenatti said “there was nothing improper about it.” He added that Miniutti “was a client of the firm” in connection with a litigation dispute and a divorce.

Because, yeah, there's nothing at all unusual about a client getting a restraining order against you.

We should back away. For some reason there are certain people who view those traits as leadership qualities. They are nothing of the sort.
