House Democrats Immediately Demand All Records On Kushner Security Clearance


House Oversight Committee chairman Rep. Elijah Cummings (D-MD) has demanded that Trump immediately turn over all records related to Jared Kushner’s security clearance.

In a letter to the White House, Cummings wrote, “I am now writing a final time to request your voluntary cooperation with this investigation. I ask that you begin producing all responsive documents immediately, and I request that you begin scheduling transcribed interviews with each witness identified by the Committee. Please provide your response to the Committee by March 4, 2019.”

Cummings has been trying to get the documents and all related correspondence about Kushner’s security clearance for nearly two months. The White House has continually stonewalled him, and it is clear that he has had enough.

Rep. Cummings wants to know why the officials did not want to give Kushner a security clearance, “Today, I am writing in light of grave new reports that—just eight days after the Committee launched this investigation—President Trump may have falsely claimed that he played no role in the security clearance process. If true, these new reports raise grave questions about what derogatory information career officials obtained about Mr. Kushner to recommend denying him access to our nation’s most sensitive secrets, why President Trump concealed his role in overruling that recommendation, why General Kelly and Mr. McGahn both felt compelled to document these actions, and why your office is continuing to withhold key documents and witnesses from this Committee. ”

Democrats are dropping the hammer on Trump

1. The title may say "demand"... but it doesn't look like it so far

A "request" for their "voluntary" cooperation" sure doesn't sounds like a "demand" or that Democrats "are dropping the hammer".

I'm not sure it's a resolved question whether the House has oversight powers in this case at all (which may be why they're requesting voluntary cooperation in the first place).

2. If the WH won't play ball with them, then all they need to do is obtain

the names of the Federal employees who reviewed Kushner's security clearance documents and invite him/her/them to come before the committee and explain why he/she/they recommended denying top secret clearance to Kushner. Democrats will have to be creative in figuring out how to get through the road blocks that Trump and his minions will try to throw in front of them.

6. That's "all" they have to do?

Executive branch employees can't testify regarding classified information without the permission of the DOJ and/or others in the Executive Branch. Republicans ran into that over the last couple years themselves when DOJ attorneys wouldn't let witnesses answer questions... and that's when both branches were controlled by the same party.

8. Demand isn't 3 days later Congressman... There has got to be something that can be done immediately

 

when national security is at stake and the person involved is meeting with a murderer known to want nuclear capabilities.

17. Do Presidents have the ultimate authority to issue clearance, whether warranted or not?

 

If so, I'm not sure this investigation can result in anything prosecutable. Issuing clearance illegally is far different than issuing clearance that wasn't recommended by his advisors.
