Hope Hicks agrees to give House Democrats some documents after White House tells her not to comply with subpoena

“• Former White House staffers Hope Hicks and Annie Donaldson have been instructed by the White House not to comply with the House Judiciary Committee’s subpoenas to turn over documents related to their time in President Donald Trump’s administration.

• But former White House communications director Hope Hicks says she will still hand over documents related to Trump’s 2016 presidential campaign, according to the House Judiciary Committee.”

So she kind of has to on those. Though he hasn't really claimed privilege on the others but just said it's a possible reason.

that if she or anyone else actually get in legal trouble he won’t lift a finger to help them, other than to tell them to get their own lawyer.

He would be fine if everyone of his staff ended up in contempt of Congress and thrown in jail. He expects that kind of loyalty, but he has a double standard. He expects them to go to jail for him too, and will do nothing to help them.

Well if that’s what it takes...

I thought you meant like she'll turn into a "Faces of Meth" post or something. She'll still be pretty when she gets out, at least nothing some expensive dermo treatments can't fix, courtesy of Trump Tower Spa...

Perhaps she has figured out that Trump is essentially not worth the bother to defend, and certainly not worth the consequences of defending. If she is smart, she will consider that the Trump chapter of her life as over.

If the documents have been subpoenaed, the custodian is legally obligated to turn them over. If the White House believes they are protected by some kind of privilege, they need to invoke it and give specific reasons. But they have no legal right to just give a blanket "order" not to turn over any documents.

Trump's previous practice in private life was to threaten to sue people into oblivion, which was a real disincentive - but, ironically, now that he's the all-powerful Oz, he no longer has that kind of authority. If he tried to sue someone over this - either officially or in his private capacity - the case would immediately get thrown out of court on a 12(b)(6) motion for failure to state a claim since he has no legal standing to bring such a suit in this instance.

That's my take. I'd be curious to see what other lawyers on the board think.

privilege protection, but some of the White House documents might. She can easily turn over the campaign materials without violating a privilege but may have been advised not to turn over the WH documents just yet until any executive privilege issue is sorted out.

Then those would be about the lie they cobbled together, when they were all on AF1, regarding the Russian meeting.
