But that judge has asked for the appeals court to send it back. Whether SCOTUS will do the right thing and likewise defer on a decision on their case, given new evidence, is questionable. And if they don't defer there are a few differences in the two cases that it is unclear that it is automatically wiped out. Depends, I suppose on how broad the SCOTUS decision.
