It's still a crime. A prosecutor has the discretion to engage you into the criminal justice system. Any given prosecutor can't indict every single accusation of crime, much to the frustration of the victims.

Here, the DOJ made it clear that notwithstanding if there truly were a strong case to prosecute a crime by a sitting President, its office was prevented by tradition of not being the vehicle to prosecute. It's still a crime. It's illogical to claim innocence. You might as well claim that it never happened.

consider indicting a sitting president. He did not come back to say there was no justification to indict Trump, just that that was not an avenue open to the Special Counsel. Hardly exculpatory.
