I can only see him trying to grab as many powers as he can, though he is obliged to make notice of which ones he plans to use, though we know he does not seem to follow any of the rules and may not.

Well, no surprise if the is true. We paranoid patriots would assume he did what he did for this reason and knew he would do this then, etc. What he could seize control of and declare from emergency powers...well, kiss it all goodbye.
