(4,788 posts)is that some, if not all, social programs are unconstitutional. Therefor they should be done away with. Ol' Roscoe here is just bleating this latest idiocy from those great Constitutional scholars - you know, Newt, Mitt and Ron.
As for Roscoe's question on how did the Holocaust happen in Germany, apparently he is not aware of the role German antisemitism played in providing fertile ground for such evil to take root and flourish.

(5,756 posts)Unless I totally misread it and given some rather substantial rulings by many federal courts and SCOTUS congress is granted the right in the Constitution to pass laws. As long as those laws don't violate the Constitution or Bill of rights and are signed into law by the executive they become effective. If you have forgotten civics that means all three branches agreed.
I may have missed it since I am not a constitutional expert but I think we've operated on the mode for many years that if it is not explicitly addressed or even spoken to by the Constitution or Bill of Rights it is fair game for congress. We call that legislating I think.
Otherwise I'm not sure how we would have an interstate system or power for rural US citizens in the South provided by the TVA since neither of those are explicitly called for by the original constitution. Oh, and take out that Hoover dam. They were all approved and funded by that nasty socialist government you so hate. Next time you get on the interstate to go to grandma's house for thanksgiving you might want to remember that. It is coming up soon in only two or three months.
And now let's talk about the defense budget. Congress People would be right to eliminate the DoD under your philosophy. One of the things most people don't realize is the fear our founders had of an organized military. They had been subject to the UK Crown for so long they did not want to have it replaced by a US military. Hence the fact there is only that pesky little second amendment and no declaration for a DoD or military force in the Constitution. They didn't fucking want one.
These idiots are perfectly happy to have added "In God We Trust" to all coinage back in the 50s - meaning of course their Christian God in the face of the Communist Threat. But all hell will break lose if we help people get educated. It isn't even a grant. It is a loan they have to pay back so it's not a freebie.
