This decision was only by a three-judge panel of the Appeals Court. It will go to the full appeals court and we should get a good decision out of it

They could petition for en banc review by the DC Circuit although those petitions aren’t often granted, but given the magnitude of this case it very well might be.

10. Fankly, i am sick and tired of all these legal experts telling us these cases are slam dunks

and then one case after another we lose. The McGahn and now it appears that the tax return case is going to be dismissed. A DUer posted some time ago a quote from a federal judge who said “the judiciary will hold”. Well the judiciary is not holding. i agree with Schiff , the DC appeals court was wrong. Who the F do you go to to enforce a lawful subpoena? The ruling is wrong that the courts done get involved in fights between the branches of government over enforcement of disputes between Congress and he Executive. Make McGahn go to Congress and then exert privilege if he wants.

We still had a functioning Constitution. We don't. This will be upheld on a 5-4 vote.
