Its keeping historians and constitutional scholars up at night and, based on offline conversations Ive had with D.C. conservatives I know, is something the GOP and partisans within the Trump administration are already discussing.

The GOP has done this before, an action that included multiple threats of violence and bloodshed on the floor of Congress, leading Democrats to cave in even though their candidate won the popular vote and had 22 more electoral votes than the Republican (who became president).
Additionally, the Constitution says that if a presidential election really turns into a mess with multiple claims of fraud or some other crisis, the president is selected by the U.S. House of Representatives.
While that sounds like good news, with Democrats controlling the House today, each states delegation only gets one vote50 votes from 50 states determine the president. And a majority of the states are Republican-controlled, so this remedy would put Trump into office regardless of how badly he lost the popular vote, the electoral vote, or both.

This makes for sober reading. I tend to think the way he is fucking up right now will be too much even for the soulless devils in the republican party and they will not try something like this. But, it is right to ask this question cause Trump is likely to try and squat when the electorate waves bye bye in November.

(10,252 posts)There are more than enough judges, who are ready, willing, and able to swear in the next POTUS. Even if Trump barricades the WH (unlikely) a Fed judge can simply swear in the next duly-elected POTUS anywhere, who will then send in the US marshalls, FBI, and DC police to restore order.

Should the Republican states install Trump, horrible as that may be, it is ultimately the will of the people and we could just be stuck with it. Law and history do not automatically lead us to the "correct" answers.

(401 posts)is if Sen Sanders launches a 3rd party Justice Party campaign and Gov Kasich and Sec Haley crank up a 4th party Normalcy campaign.
The other two campaigns could siphon enough EC votes to deny anyone 270.
Since the HoR chooses between the the top three EC vote getters, it could come done to Trump, Biden, Sanders.
The current HoR casts the votes, one vote per state.
I can't find the current breakdown, but as I recall the Rs control more state delegations.
We have more Reps, but they control most states.
Then the Senate chooses the VP.
