Attorney: Raritan Township homeowners have First Amendment rights to oppose developer

People who oppose development projects have First Amendment rights to challenge developers, says an attorney who represents a group of homeowners who were sued by a developer after his application was rejected.

The developer's lawsuit should be tossed out, he said.

The lawyer represents 16 of the 19 homeowners named in a lawsuit after the zoning board denied an application for a solar field project.

"Bascially you're trying to deter people like homeowners from exercising their First Amendment rights to object or participate in this type of proceeding… He's asking them to be relieved (of the suit) in exchange for giving up any rights to participate in future proceedings."

While I'm sorry the homeowners objected to solar panels, I agree with the decision. Imagine if Donald Trump came into your neighborhood and sued you for objecting to his next "amazing, fantastic" project.
