Gore was the defendant arguing for the recount to proceed, Bush was the plaintiff arguing the recount be stopped. SCOTUS ruled the recount be stopped and awarded the presidency to bush.

The democrats did not fold their tent. Short of raising an army and storming the Supreme Court, there were no options remaining. They lost the argument because the fix was in.

John Roberts was lead attorney for bush and was rewarded for his efforts.
