Even with Trump getting blown out in the election...

You can bet that it will be contested in the Supreme Court.

1. Exactly

And two weeks from this coming Monday, the 2020-2021 term of the SCOTUS starts, with a 5-3 Republicon majority. Any arguments scheduled from that day until the day that a successor is sworn into office will not have their outcome affected by the addition of the new Justice.

4. Yes

but clearly, Chief Justice Roberts has defended the ACA in prior opinions. But tied decisions have little value as precedent, under the doctrine of stare decisis, where what has been decided will prevail in future cases.

5. Roberts really has his hands full now

It has been obvious that he has been trying to level off the decisions in order maintain a non-activist court.
The credibility of the entire judicial branch is now in jeopardy because of McConnells packing with often unqualified judges.
