(816 posts)Let's say they ram through this SCOTUS nomination. It looks like they will. So now Trumpo can make a mess of the election, and have the SCOTUS appoint him. Then what? Does he think repubs will win the presidency AND the Senate? Doubtful. So he wins a second term, the house impeaches him again, and the new Democratic led senate throws him out on his ass.
Repubs have NO end game here.

(216 posts)But doesnt necessarily affect the outcome of the appointment. Too many holes in the Constitution on the issues. I dont think it specifies how, or if, an election can be invalidated. Even a 4-4 vote is a non-decision.
I dont believe there is any way to require a justice to recuse themselves. It is left to their own ethics and morals to make that decision. I dont think even the Chief Justice can require it.
Not sure the court would choose to rule with only 6 justices, which would still be 3 - 3.

(216 posts)the accusations are startling and criminal, once proven. Much like Muellers investigation, years of accusations from Congress and in the press. Then Muellers report tells most uninformed voters there was found no prosecutable evidence of collusion/conspiracy.
As to the judges, I dont think crimes prior to the election invalidates the election. Crimes after the election probably wouldnt invalidate the appointments. I dont believe the Constitution says anything about invalidating an election.
Not sure if Nixon made any appointments after planning Watergate, but would provide a precedent, as I dont think they even tried to remove them.
The Constitution says executive appointees can only be removed through impeachment after theyve been confirmed and been sworn in.
No matter whose impeachment you naught start it wont slow down the confirmation much, if at all.
If the impeachment was completed with the removal of anyone except the President, thered always after the election until inauguration.
Even if he is impeached it is arguable that until removed the appointment is still valid and actionable by the Senate.
Lots of Constitutional questions there, but at the least would probably require the successful impeachment and removal of the President. All would require separate decisions from the Supreme Court, although in a single filing.
But still worth while it is something to keep the press and public interested and occupy news cycles. Probably have to start process as quickly as possible,before it is seen as an unsubstantiated empty threat. That could be a big negative.
