They would have to be impeached. And that isn't going to happen.

So if they just get ornery, they would continue to hold the seat while in prison.

Typically the scumbags just resign though. They aren't required to however.

Legislators can be removed without impeachment or trial by the house for which they are a member. Senators and Reps can be indicted, tried, convicted, and jailed like normal people. The only restriction is that they cannot be arrested while traveling to or from a congressional session.

It would still be up the senate to remove them, which won't happen unless they have a gop governor, and probably not even then.
