(265 posts)The Chief Justice is certainly the traditional choice, but is not required. I'm thinking of the famous photo of Lyndon Johnson getting sworn in by a local Justice of the Peace in Dallas 1963.
And should anyone voice the idea that it would be a snub to the CJ, I would say Garland's was the bigger snub.

(26,044 posts)JFK was dead. The office of President was vacant. It would be about a three-hour flight back to D.C., and they didn't want to have the presidency unoccupied during that time, as it might have prompted an adversary to figure we were in chaos and try something (just like how the Air Force started special patrols along our borders when Trump had to be rushed to Walter Reed last month). There was no time to get LBJ back to the White House or to fly Chief Justice Warren down to Dallas -- the needed the Oath administered immediately, and basically found the authorized judge who could get to the airport fastest.

(265 posts)Anyway, it's a pipe dream way in the future. Biden may not want to make those particular waves. It probably will be Roberts.
But still ... using Garland would be a nice touch.
