November 11, 2020
By David Edwards
Fox News senior White House correspondent John Roberts now says hes not sure who will be the next president even though his network has called the race for President-elect Joe Biden.
Roberts told Fox News host Bill Hemmer that he expects Republican legislators to have a hard time allowing electors to cast their vote for Biden when the Electoral College officially chooses the next president on December 14.
One thing is that if they do manage to prolong this process, we start to get into December, Roberts asserted. There comes a time when these electors have to be seated to vote on who will become president of the United States. And Im told that the anger out there in these red states is so deep and so palpable, the GOP legislators may have a difficult time seating Biden electors when it comes down to putting in place that process for the vote on December 14th.
At some point, you know, people keep on assuring us that on January the 20th a president will be inaugurated, Roberts added. Were just not sure at this point whether it will be a new president or the current president.
Thats some really interesting reporting, Hemmer concluded.

(34,358 posts)know it won't work here in Michigan because the legislature has no power over choosing electors. I don't know what the laws are in other states, though. But just fomenting magat anger is so fucking irresponsible and it's so sickening to see roberts pushing this seditious crap. He was one of the few reporters at fox with a shred of integrity. Not anymore.

(128,701 posts)have legislatures that are either all-(D) or mixed-(D)/(R) with either a (D) or (R) Governor -OR- if they are all-(R), have (D) Governors but don't have super-majorities to override a most-certain veto.
So it makes this all moot because even if they supposedly could change their laws to do such a thing, the (D) Governors would veto it.

What are they so angry about? That more people in their states voted for Biden? That's their idea of what induces wrath?

(43,240 posts)Zero chance the union survives over the long term if these systemic inputs are continued and even expanded upon. Divisions will only increase, reality and objective truth refused and denied, cast aside as though it was the act of a child putting aside childish toys. A preternatural hate, a thoroughly embedded fear of 'the other', and simply an unquenchable lust for violence will eventually carry the day with the white nationalists and act in a kinetic manner they shall.
My true fear is that the forces allied against this death cult are too atomised, too divided, and at loggerheads with each other to offer up an efficacious countervailing blocking mechanism.

There is something going on that Democrats do not understand. These people in their 20's - 40's do not even care if there is an election. Just as long as a macho man like Trump is in office.

(128,701 posts)and we have a (D) Governor. I posted this down-thread but will stick it up here -
In states like PA, it is the Governor, not the state legislature that selects the electors and we have a (D) Governor and majority-(D) State Supreme Court.
Disputed elections fall to the courts, not the Legislature, under the Pennsylvania constitution. Also, state law also does not give the Legislature the ability to appoint presidential electors, a reality GOP leadership have reinforced in public comments over the past week.

I may be wrong but I don't think any of the states that have been "called" for Biden so far have a GOP-majority legislature WITHOUT a Democratic Governor (like PA, MI, WI) except for NH, which is all-GOP (but only has 4 electoral votes).

(128,701 posts)and that happened this past Saturday. Celebrations broke out all over the city, the state, and frankly all around the world!
In fact yesterday at our weekly city COVID-19 presser, the Philly Health Director recommended that anyone who attended one of those "celebrations" quarantine for 14 days since we are spiking with coronavirus here now. (they reported 879 positives yesterday and 761 today).
The state law requires an automatic recount if the difference is < 0.5%. Right now it is slowly closing in on a 1% difference and it has already surpassed what 45 got in 2016 over Hillary (which was ~44,000 votes).

The bottom line is that legislatures cannot change the law after an election--only before. And there is neither evidence that the state election failed to document a clear result in any state. That would be the requirement for a legislature to have ANY role.
