So Trump will be acknowledging his guilt twice, offering, and accepting a pardon.

If dna evidence proved I was wrongly convicted, then obviously accepting a pardon wouldn't be an admission of guilt.

If I was railroaded by a biased jury, prosecutor, etc., then obviously accepting a pardon wouldn't be an admission of guilt.

The burdick case involved the government trying to force a pardon on someone in order to invalidate their 5th amendment rights and thereby to compel testimony. Burdick found that the government can't do that. Unfortunately, it mentioned this notion that accepting a pardon would amount to an admission of guilt in this case, and this has been throwing people off ever since.

It wasn't a necessary part of the reasoning in burdick. Simply that the government couldn't force someone to surrender their rights was enough. Burdick was entitled to refuse the pardon and keep his 5th amendment rights.

Wondering what would happen if it were litigated.

The UNpresident is so simpleminded he thinks he can just make up something like "band wagon" out of nothing!
