President Biden place her in that Cabinet position anyway?
The former guy filled his Cabinet with inept, incompetent, corrupt Cabinet members. Why wouldn't/shouldn't Biden have the qualified, non-white female in that position?
I'm sick of Dems sticking to a set of rules that republicans/conservatives ferl free to ignore at their convenience...😠

(9,073 posts)When Trump appointed a guy as acting secretary of DHS, judges ruled it unlawful and started turning over things.
There are very specific instances to appointing acting Cabinet positions.

The "former guy" made lots of "acting" selections, but that doesn't mean that he had the ability to just pick whoever he wanted.
Tanden has not been senate confirmed for some other post and is not currently the first assistant for the previous OMB head, nor was she a senior officer in OMB for 90 of the 365 days preceding the vacancy.
She is therefore not eligible to fill the role as an acting head.
