Court rules for Florida in cruise case, grants injunction stopping CDC order

Orlando Sentinel *(Paywall)*

A federal court granted a preliminary injunction against the Centers for Disease Control and Prevention and its conditional sail order that has shut down the cruise industry during the COVID-19 pandemic.

The ruling by U.S. District Judge Steven Merryday is part of a larger lawsuit brought by the state of Florida that contends the CDC has overstepped its authority through its orders that have limited cruise lines’ ability to return to business.

By granting the injunction, the court deemed that Florida was likely to succeed in the overall case on its merits, demonstrating the state would be harmed if the order continues, but also sent both the state and CDC back to mediation.

1. An HW Bush Appointee

Just for context
also, not trying to proffer a learned legal opinion, just a personal one, but sending it back to mediation sounds like punting, to me.

4. The State would be harmed?

How about the people on the ships and the ones they come in contact with after their cruise?

Ahhh, who am I to say? Who the hell cares about people when there are cruises to run? Let‘s get our priorities straight here. I‘m sure Marco Rubio, Rick Scott snd Matt Gaetz will be seen on a cruise docking in their state any day now! Right?

Right?

Oh. No way, huh?

Never mind!

5. It's hot and humid in my state. I'd skip vacationing here. And we still lead in COVID.

Callous disregard for human life.

8. If cruise ships can't staff their ship then they can't sail.

10. Let 'Em Sail, Oh Wait

Royal Caribbean is being forced to postpone the inaugural sailing of one of its cruise ships after eight crew members tested positive for COVID-19, reported CNN.

The Odyssey of the Seas’ scheduled Caribbean voyages out of Fort Lauderdale were originally set to begin on July 3 but they’re now being pushed back to the end of July.

Although all of the Odyssey’s 1,400 crew members were vaccinated against COVID-19, the positive tests came before the vaccines were fully effective.

12. Let the Dying Proceed!

Delta strain, about to become dominant is more easily transmissible, bypasses previous immunity to some extent (ie if you had COVID last year, you may still catch it again if it's the delta strain), bypasses Pfizer vaccine response somehwat, making that 88% effective.

One person with the delta strain gets on board one of those ships, a week later, 100 people will be walking off/carried off the ship with COVID even with the CDC mandated 95% vaccinated requirement.
