Two service members filed a potential class action lawsuit against Defense Secretary Lloyd Austin to attempt to block him from requiring all troops receive a COVID-19 vaccine.
Army Staff Sgt. Dan Robert and Marine Corps Staff Sgt. Hollie Mulvihill, who filed the complaint Aug. 17 in the U.S. District Court of Colorado, also want the Pentagon to create a vaccine exemption for those previously infected with the coronavirus as they already have "natural immunity."
The two, who are both based in North Carolina, argue that the Defense Department's vaccine mandate "is in open violation" of the rights of service members and is unconstitutional.
Austin is named as a defendant in the lawsuit as are Health and Human Services Secretary Xavier Becerra and Janet Woodcock, acting commissioner of the Food and Drug Administration (FDA).

(2,081 posts)So disobeying a lawful order. Sounds like something the courts martial should address. But then to E-1, give them a several year stay at Club Fed making Little Rocks from big ones, then dishonorable discharge. Vaccinations are mandatory for the service since disease can take down a unit easily

(50,530 posts)This is where you get your haircuts, uniforms, kill off two trees filling out paperwork...I was in Reception for a week - I think it's longer now - and there were two immunization sessions during that time. Then a few weeks after you join your basic training company you are marched back to Reception Station for a third round of immunizations.

(435 posts)The military has the option to just discharge them from the service for not being compatible with the service for refusing the vaccine. It doesn't take a lot to discharge a military member in 30 days with no UCMJ action happening. Back when I was in the US Army in the 1980's if a soldier was arrested for a serious civilian crime the army would discharge them under general conditions and deliver the paperwork to the soldier in jail.

(57,013 posts)... voting for Democrats for national office for about twenty years. I do vote for one GOP judge. I know Judge Oak and he is a fair judge, and he hasn't had anyone run against him in the fifteen or so years I've been in town.
