Michigan AG Dana Nessels office said in a statement Thursday it had received notice Texas Office of the Chief Disciplinary Counsel has granted an investigatory hearing related to Powells law license, which will take place November 4.
Nessel, Michigan Gov. Gretchen Whitmer and Secretary of State Jocelyn Benson filed complaints in February with disciplinary boards in Texas and Michigan against Powell and three other lawyers behind a post-election lawsuit alleging widespread fraud in the state, which argued Powell violated multiple rules of professional conduct for Texas lawyers.
Powell violated rules that prohibit attorneys from bringing frivolous complaints, knowingly mak[ing] a false statement of material fact or law, using evidence the attorney knows to be false, and engag[ing] in conduct involving dishonesty, fraud, deceit or misrepresentation, the complaint alleged.
The Michigan officials complaint was separate from their motion for sanctions in Powells Michigan lawsuit, which was granted Wednesday as U.S. District Judge Linda Parker ordered Powell and her co-counsel to pay defendants attorneys fees and undergo additional legal education.

(50,826 posts)or sufficient penalty. As a warning to other attorneys not to allow attorneys from other states to use them as a way to go before the court. Financial penalties are needed too.
