Nicolle Wallace opened 'Deadline White House' with some comments from a NY Times article...below is the gist:
The Select Committee entering uncharted waters
agonizing over what to do with the group of Republicans
intent on stonewalling the Jan 6 probe
for weeks [the Committee] have agonized over how aggressive to be in pursuing sitting members of Congress
[weighed] against the potential legal difficulty and political consequences
In other words, they're afraid to subpoena McCarthy, Jordan and whomever else they have on the list.
I can guess the political consequences but not the legal.

Someone subpoenaed could challenge it in the courts and ultimately it would be up to them to decide.
