Truck driver gets a year in jail for striking, killing man changing tires

A Cumberland County, Pa, man was sentenced to 1 to 2 years in Cumberland County Prison Tuesday for crashing into and killing a Washington D.C. firefighter while he was changing a tire on the shoulder of Interstate 81 near Carlisle nearly four years ago. The victim, 57-year-old Robert Marshall of Hedgesville, W.Va., died in the Hershey Medical Center eight days later.

Robert A. Runyon, 50 was legally drunk at the time of the crash ... police found an open, 16-ounce Miller Lite beer can on the driver-side floor. Runyon submitted to a blood test, with
his blood-alcohol content level coming back as 0.225 percent – higher than the legal limit of 0.08 percent. But Runyon received a huge legal break when his .225 blood alcohol content result was thrown out because Pennsylvania State Police working the crash did not fully explain his right to refuse a blood draw.

Runyon can be considered for work release after the first six months of incarceration. Runyon will be under county supervision for up to five years after his release from jail. During the course of that supervision, Runyon will be prohibited from buying, possessing or drinking alcohol, subject to random testing for alcohol use, and ordered to give 50 hours of court-approved community service annually.
