Fox News is mangling Special Counsel John Durham's latest Trump-Russia filing

On Friday night, Special Counsel John Durham filed a pretrial motion on possible conflicts of interest by the lawyer representing Michael Sussmans, a cybersecurity lawyer Durham has charged with allegedly lying to the FBI. But he also "slipped in a few extra sentences that set off a furor among right-wing outlets about purported spying on former President Donald J. Trump," Charlie Savage writes in Monday's New York Times.

Trump and allied media organizations say Durham's filing, as Fox News' Brooke Singman put it in a widely cited early report, shows that lawyers for Hillary Clinton's 2016 campaign "paid a technology company to 'infiltrate' servers belonging to Trump Tower, and later the White House, in order to establish an 'inference' and 'narrative' to bring to government agencies linking Donald Trump to Russia." Those claims were repeated Monday on Fox News' daytime news and prime time opinions shows.

"But the entire narrative appeared to be mostly wrong or old news," the conclusions "based on a misleading presentation of the facts or outright misinformation," Savage writes. Gabriel Malor, a lawyer who writes for several conservative media outlets, lays out a few specific points on Durham's filing, including that it never uses the word "infiltrate" or accuses the Clinton campaign of ordering Sussmans or anyone else to pass the tech company's analysis of DNS data to the FBI or CIA.

Savage summarizes the competing narratives from Durham and the cybersecurity experts who compiled the contested DNS data, adding that the right-wing mischaracterizations "involve dense and obscure issues, so dissecting them requires asking readers to expend significant mental energy and time — raising the question of whether news outlets should even cover such claims." Lawyer Marcy Wheeler, who writes at Emptywheel, has a lot more detail about Durham's filings and Kash Patel's involved role in this story.

Where there is the possibility of democracy, there is the inevitability of elite insecurity. All through its history, democracy has been under a sustained attack by elite interests, political, economic, and cultural. There is a simple reason for this: democracy – as in true democracy – places power with people. In such circumstances, the few who hold power become threatened. With technological changes in modern history, with literacy and education, mass communication, organization and activism, elites have had to react to the changing nature of society – locally and globally.

From the late 19th century on, the “threats” to elite interests from the possibility of true democracy mobilized institutions, ideologies, and individuals in support of power. What began was a massive social engineering project with one objective: control. Through educational institutions, the social sciences, philanthropic foundations, public relations and advertising agencies, corporations, banks, and states, powerful interests sought to reform and protect their power from the potential of popular democracy.

The development of psychology, psychoanalysis, and other disciplines increasingly portrayed the “public” and the population as irrational beings incapable of making their own decisions. The premise was simple: if the population was driven by dangerous, irrational emotions, they needed to be kept out of power and ruled over by those who were driven by reason and rationality, naturally, those who were already in power.

The Princeton Radio Project, which began in the 1930s with Rockefeller Foundation funding, brought together many psychologists, social scientists, and “experts” armed with an interest in social control, mass communication, and propaganda. The Princeton Radio Project had a profound influence upon the development of a modern "democratic propaganda" in the United States and elsewhere in the industrialized world. It helped in establishing and nurturing the ideas, institutions, and individuals who would come to shape America’s “democratic propaganda” throughout the Cold War, a program fostered between the private corporations which own the media, advertising, marketing, and public relations industries, and the state itself.

“Trump could end up in an orange jumpsuit at the end of that one,” said Timothy O’Brien, a senior columnist for Bloomberg Opinion.

O’Brien also has a personal stake in this story. His book TrumpNation, a 2005 biography that raised doubts about Trump’s actual wealth in eerily similar terms to the James and Bragg investigations today, so irked the real estate developer that he sued O’Brien for billions of dollars.

O’Brien’s lawyers deposed Trump as part of his defense. Over two days they managed to do something that has rarely been done before or since – they got the celebrity to acknowledge, no fewer than 30 times, that he had lied.

“My lawyers were so well prepared that when he sat down for the deposition we had documentary evidence at hand that showed the reality of what he had lied about or exaggerated. We simply pushed those over the table at him,” O’Brien recalled.

Many of the misleading elements – the value of his golf clubs, real estate assets in New York – were virtually identical to the details contained in this week’s filing. Which is why O’Brien feels confident in saying that the patterns that James outlines in her court document extend far back.

Former Fox News host Gretchen Carlson slammed her old employer during a Thursday appearance on CNN.

Asked why Tucker Carlson and other star hosts push “the big lie” around the 2020 election, among other things, and why the Murdoch family allows their network to do so, Carlson responded, “Ratings, I think, first and foremost, but this is the result of fake news. You know, we’re seeing not only the fallout from fake news during the Trump era, but what happened with the insurrection on Jan. 6, and now it’s moving into other areas, not just news. Now it’s hitting science with vaccines and now it’s into Cold War politics.”

During Attorney General, William Barr’s confirmation hearing, he was mostly peppered with questions about how he would handle the Mueller Report. Senator Ben Sasse’s (R-NE) questioning, however, diverged from the pack. Sasse asked Barr about the lenient sentence given out to billionaire pedophile, Jeffrey Epstein. The future Attorney General told Sasse that he would look into the matter.

This, however, was not the first connection between Barr and his family and the disgraced pedophile. In 1973, Barr’s father Donald, the headmaster at Manhattan’s Dalton School, hired Epstein as a calculus and physics teacher.

While hiring Epstein, a noted mathematics genius, was not strange on its face, the hire was unusual for a number of reasons. Epstein had not earned a college degree as he dropped out of New York’s prestigious Cooper Union. The other odd circumstance was that the new teacher was only 20 years of age.

Apparently, the hire was a successful one. The New Yorker wrote in a 2003 profile on Epstein, “he was something of a Robin Williams–in–Dead Poets Society type of figure, wowing his high-school classes with passionate mathematical riffs.” Epstein’s mathematical skills caught the eye of Bear Stearns’ chairman, Alan “Ace” Greenberg, whose son attended the Dalton School. Greenberg hired Epstein as an options trader and the former teacher was able to amass a fortune.

Still doesn't explain why Garland hasn't come out and said this is a political investigation and just shut it down

If the tables were turned any good Republican that was above board would have done it if Garland started investigation before he left office
