Jan 6 committee has determined Trump committed crimes
The Jan. 6 select committee says its evidence has shown that then-President Donald Trump and his campaign tried to illegally obstruct Congress’ counting of electoral votes and “engaged in a criminal conspiracy to defraud the United States.”

Of course Biden doesn't want to, or even be seen as wanting to, interfere with DoJ operations, but he certainly has the right to be briefed by Garland about progress of the Jan 6 rioter cases or about Garland's current priorities at DoJ. Garland was nominated presumably because he was a good fit for the direction Biden wanted at DoJ, but if that has changed, then Biden has the right to ask for Garland's resignation.

That is why the WH and DOJ only communicate via their respective counsels. Any direct contact (as between Trump and Sessions/Barr) would taint DOJ with being politically influenced.
Yes, Biden could fire Garland, but has shown no such inclination, so the only option for those who feel Garland is derelict is impeachment. |

Of course, grassroots pressure upon our reps is good, but we also need massive pressure from the White House as well. There is know way for us to know if such pressure exists.

I had a feeling then he was going to get away with it. When that day was over and he was never cuffed and was allowed to sleep in his own bed, I had a feeling he was going to get away with it. Somehow he always seems to slither away from any jail time. It'll be the same for the charges in GA and NY. Those will be postponed indefinitely until they can claim that he has dementia. No jail for Donnie. Not in this life. Any punishment he receives will be in the afterlife, if you believe in that sort of thing.

to indict anyone let alone convict. Does it matter what this judge decides? I'm sure Eastman will keep appealing until after the election.
DOJ could get the emails a lot quicker if it wanted. One thing about it, the select committee is going to put on quite the show, hopefully in prime time, to show the country all of the crimes that Trump and his cronies could have been convicted of. |

The January 6th Committee knows that if the Republicans regain the House it will be disbanded. They are laying the groundwork to send criminal referrals to DOJ backed up with their good faith beliefs and findings to give DOJ enough to follow thru. A Republican house can't touch Biden’s DOJ.

61. Eastman is claiming attorney-client privilege
prevents him from turning over documents the Jan 6 Cmte wants. The J6 cmte filing is a response to that. It takes the position that the documents are covered by the "crime, fraud exception" and in doing so makes the case that the committee has "good faith" evidence that Trump, Eastman, et al, were engaged in a conspiracy to defraud the US goverment and are, therefore, entitled to these Eastman documents.
This position was telegraphed weeks ago when Liz Cheney used the specific language of the US code statute during a public meeting of the J6 committee. |

67. Is this the REFERRAL we have been
waiting for ? I think trump (and other higher ups) will have to confess to all crimes in writing and video for anything will happen. He will probably have to walk himself into prison.

73. Trump should be indicted and get the same punishment as Mitchell, Haldeman, and Ehrlichman
received for the crimes they committed during Watergate—at the very least! He should actually get a worse punishment since the insurrection was about 1,000 times more egregious than what Nixon's minions did.
From the New York Times (1975): WASHINGTON, Feb. 21—John N. Mitchell, H. R. Haldeman and John D. Ehrlichman, three of the most powerful men in the nation during the Nixon Administration, were sentenced today to serve two and a half to eight years in prison for their roles in the Watergate cover‐up.
Robert C. Mardian, a former Assistant Attorney General, who was convicted with the others last New Year's Day after a three‐month trial, was sentenced to 10 months to three years. Judge John J. Sirica of Federal District Court imposed the sentences at the United States Courthouse. He did so quietly and with little emotion, addressing the defendants one by one, in a brief, somber and tense proceeding. Conspiracy Charged The four men were convicted of conspiring to obstruct justice in the original Watergate investigation through such means as paying “hush money” to the Watergate burglars in return for their silence about the break‐in of the Democratic National, Committee, headquarters at the Watergate office and apartment complex on June 17, 1972. All but Mr. Mardian had also been convicted of obstruction of justice, and in addition, of various counts of lying under oath.
