(13,749 posts)The three Democratic-appointed justices Stephen Breyer, Sonia Sotomayor and Elena Kagan are working on one or more dissents, according to the person. How Chief Justice John Roberts will ultimately vote, and whether he will join an already written opinion or draft his own, is unclear.
I haven't seen any confirmation of this, or any more information on CJ Roberts.

(2,518 posts)I'm trying to keep up here. Honestly I thought the case was based on 15 week termination not the whole thing going back to the states

(3,213 posts)Alito and the conservative majority said that Roe and Casey should be overturned completely and send it back to the states. They voted in favor of that in the draft.
Alito says any law decided by the 14th Amendment should be overturned.

(26,731 posts)5-4 is the assumption because Alito wrote it. If Roberts were part of the majority, most assume that he would select someone else to write it.
