I wonder if any judge has ever considered

That the framers of the constitution did not consider an unborn fetus to have the same status as a live baby since they clearly said to be a citizen you had to be BORN in the United States. They definitely had a specific idea about the timeline.

I'm no legal expert, but I think there is an argument to be made.

And a clause in the 14th Amendment. Framers didn't view black human beings - as human beings.

Technically - we didn't even get that full citizenship until 1964.
