BREAKING: Michigan court stops enforcement of state's 1931 near-total abortion ban, which could go back into effect if Roe v. Wade is overturned. It's an early court win for Planned Parenthood.

Defendant in case is AG Dana Nessel, who agrees 1931 ban is unconstitutional & says she won't defend law. The judge, Elizabeth Gleicher, disagrees with AG's contention that there's no 'actual controversy' to resolve yet. (Plaintiffs said they needed a ruling now - judge agreed.)

The Michigan Supreme Court is currently majority Democrat, so if it gets appealed to them this law will be thrown out altogether.

LANSING — A Michigan Court of Claims judge on Tuesday issued a preliminary injunction against Michigan's 1931 abortion law, finding Planned Parenthood is likely to prevail in a lawsuit saying the law violates the state constitution.

Judge Elizabeth Gleicher granted the injunction sought by Planned Parenthood of Michigan in a lawsuit brought against the state attorney general.

"As of the date this opinion is issued, it is unknown whether the U.S. Supreme Court will overturn Roe v. Wade," leaving the 1931 state law, which bans abortions except to save the life of the mother, the law in Michigan, Gleicher wrote.

Under the ruling, the state could not enforce the 1931 law should Roe v. Wade be struck down.

That means the decision is not reviewable by the US Supreme Court.

Or at least that is what has always been the law. Who knows anymore?
