There have been several court rulings that indicated that the second does cover ammunition. Gun Save Lives vs Ali is a recent one. By that standard a modest tax to support a safety program might be upheld, but anything prohibitive or punitive almost certainly would not.

Including "used" resale guns. And bullets. Keep the tax lower on traditional hunting weapons like shotguns.
