A federal judge in Tennessee has temporarily blocked the Biden administrations guidance on two federal laws aimed at preventing discrimination against LGBTQ+ people.
Judge Charles Atchley was nominated by Trump and confirmed after McConnell used the so-called "nuclear option" to drop the filibuster to get him confirmed. He says the Biden guidance will interfere with states' ability to enforce their new anti-transgender laws.
That's it. That's his legal reasoning. Executive Orders are only valid for Republican Presidents, apparently.
As it currently stands, plaintiffs must choose between the threat of legal consequences enforcement action, civil penalties, and the withholding of federal funding or altering their state laws to ensure compliance with the guidance and avoid such adverse action, continued Atchley, who was appointed to the judgeship by Donald Trump. The guidance also ignores the limited reach of Bostock, he wrote.

ARTICLE 3 SECTION 1. The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish. The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behaviour, and shall, at stated Times, receive for their Services, a Compensation, which shall not be diminished during their Continuance in Office.
Sometimes I wonder whether DU would benefit from requiring its members to have a copy of the Constitution.

That's right, though. It seems like anytime we try to get a judge appointed, we have to hear the Nazis whining about how we want to appoint "activist judges that will legislate from the bench." All the while... We're having this country torn apart and rights burnt to ashes by reich-wing activist judges legislating from the bench.
If it's not the Fascist Five unraveling gun control and Roe, it's thugs like this redneck judge Atchley basically blocking President Biden's executive orders. Executive orders meant to protect vulnerable people who have faced nonstop hatred and discrimination here in 2022.
This fascist wants to talk about harm? You wouldn't know the first thing about harm, Itchley. There has been real fucking harm done to LGBTQ's here in 2022 in those so-called "plaintiff states" who want their "state rights" (more like state rights to tear apart lives and harm innocent people.)
How dare this southern-fried crooked judge speak about "harm". The only ones that have been harmed in 2022 have been us. And I'm also going to guess he did not speak to one LGBTQ before issuing this horrible, hateful ruling.
I'm beyond sick of this shit. We're just trying to live our lives in peace while one so-called "party" of goons are trying to tear our rights apart. All along the way, they can count on "help" from scum like this judge. Another goddamned Drumpf-appointed judge whose only purpose is to burn the Constitution and tear the country apart.
This is absurd. Each and every day, the mask comes off and this country is revealed to be a nation of hate, bigotry, cruelty and abuse. Sure, the blue states are still fine. But the red states are becoming Jesusland, a fascist, Drumpf-humping nation of bigotry, hate, corruption and fascism.
Hopefully this can be fought back against. Because as usual, Joe Biden was trying to do truly great things with these executive orders... only to have the American Nazis derail it all yet again.
