CBSGraham was subpoenaed to testify to a special grand jury thats investigating whether Trump and others broke any laws when they tried to overturn Joe Bidens win in Georgia in 2020.
The senator is one of the Trump allies who Fulton County District Attorney Fani Willis wants to question as part of her investigation into what she alleges was a multi-state, coordinated plan by the Trump Campaign to influence the results of the November 2020 election in Georgia and elsewhere.
Graham said previously that he would fight a subpoena and he still has the ability to do so if he so chooses.
Grahams attorneys say that the probe by the Democratic district attorney, Fani Willis, is politically motivated.
Graham was ordered to testify before the Special Purpose Grand Jury on Aug. 2. The petition also states that the State of Georgia will pay all reasonable and necessary travel expenses and witness fees requited to secure his attendance and testimony.

Hes currently in federal court trying to quash the subpoena. He doesnt have to show up while thats pending.
The judge has reportedly indicated that she will either quash/partially quash it or send it back to the state court for limitations on what questions can be asked

(6,583 posts)For this particular hearing he was not required to appear personally, & his attorney, his legal representative, appeared on his behalf.
That is his legal right, just as it is yours & mine.
It's truly frustrating how often media reports are wrong or misleading, as in this case.

(5,838 posts)If the motion hasn't been decided, he still has to show up when summoned, unless that date was postponed until the motion was decided.
Issue a bench warrant and drag him into the police station under arrest. They will book him and make him promise to appear at a new date. That's how this works for ordinary folks.
