Thinking About The Special Master

I was thinking about why on earth a judge would decide for a Special master to look for executive privilege documents when the documents belong to the government?

This judge has been hinting at how this investigation is going to make Trump look bad. I believe there are classified documents that can be used to prosecute Trump. A pro-Trump Special Master can come up with an excuse to deem the classified documents that are incriminating to Trump as executive privileged documents and DOJ won't be able to use them to prosecute Trump.

I believe that Cannon wants a Special Master to nullify all confidential documents that are incriminating to Trump.

Don't laugh, this judge is already off the rails. Hey, no one else has come up with a reason.

As written, the ruling would prevent nearly all criminal investigations because they might affect the reputations of the targets.

SCOTUS already ruled against TFG back in January on the question of executive privilege; don’t see why they would reverse themselves now.

if you are talking about the J6 committee trying to get Trump documents. The SC didn't really rule on that did it? Didn't it leave it open?

We are talking about having 2 presidents at the same time, that's what can happen.

This is why I think that DOJ should appeal. It will take months to adjudicate but I don't like the Special Master scheme. Something is rotten in Denmark. The SM will declare classified documents that are incriminating to Trump are executive privileged. They will go back to the Archives but DOJ can't use them against Trump.

You have to think like a treasonous bastard.

The only way the judge's ruling won't stand is if DOJ appeals to the conservative 11th circuit. It is the 2nd most conservative circuit out of 13. If the 11th circuit rules against Cannon then Trump will appeal to the Supreme Court where it can stall taking the case for months.

They heard the case and ruled in about two months- late October 2021, ruling early January 2022.

The law and the law breaking actions by Trump are pretty blatant it seems to me.

Can he keep ANY document of any kind, classified or not, when he leaves office? Seems like a strong hell NO! Per the Presidential Records act from the late 1970s. Period.

this judge is making the call. There should have been no need for a special master in the 1st place, correct? The documents don't belong to Trump and there aren't a large volume of documents to sort through, all reasons for a Special Master that were not met and yet this judge ruled for one. Laws mean nothing to treasonous bastards. If they get a pro-Trump Special Master just wait and see what happens.

In the meantime, it is getting closer to 2023 and 2024.

I think it's an important precedent.

You don't necessarily want to have the FBI or NSA or any other executive branch agency to have fiat judgment power over disputes of possession of confidential records.

I'm confident that they'll find Trump exceeded his power (and the law) in taking classified documents home. It's a very clear-cut case. But the next time a conflict shows up like this, it might just be a Pentagon Papers dynamic, involving a reporter and the public's right to know.
