I've said all along that this is kind of a side show and the investigation will continue because the contents of the documents never really mattered in the first place. This judge has made a right ass of herself but the show will go on.

He is meticulous and always gets his man.
The evidence is undeniable on the obstruction charge as well as possessing the documents.

I am however concerned that he will not be indicted for anything. At the same time, does Garland really want to prove once and for all that justice isn’t blind and some people are indeed above the law?

I'm hoping all of this transforms from Twitter storms to RL consequences that include one very embarrassed judge whose ruling gets tossed out with the trash.

When they do, they would have an FBI agent submit a declaration saying they need the docs for fingerprinting, etc to allow the Security investigation to proceed (roughly). That puts her in a bind.

I felt they should add a declaration from the White House claiming executive privilege on all the Presidential documents. That would wipe out the Special Master for executive privilege.

They could also provide rebuttal to a few of her inventions.

Then, if the judge still turns DoJ down, they have a more solid foundation for appeal.
But even if she presses on, they've taken a bunch out of her decision and may well not need to appeal.

I think this decision is a time wasting nuisance due to its poor quality. But that's all.

It's not the DOJ's first rodeo. They may have more up their sleeves than they've been able to share up to now. I know this sounds pollyanna-ish, but the tone of their last filing and the fact that they released such an incriminating photo with it leads me to believe they are in dog-with-a-bone mode. They have their quarry in their teeth and will not be letting him go.

It's difficult, but I've been trying not to get too riled about today, since the holiday meant that this wasn't a normal news day. tfg shopping for a judge, having the judge bend over backward (badly) for him, timing the release for a holiday... it's so maddening, but it's vintage stuff. 🙄

Tomorrow's news may change my mind, but that's tomorrow. Who knows? DOJ may smack things around again in the news first thing in the morning. We'll see.
