In appeal, DOJ says urgent FBI be permitted to investigate empty folders with classified markings
emptywheel @emptywheel 34mWill return to this later tonight. But implicit to this comment is there’s not a ready innocent explanation to 90 empty folders. They’re not the unfoldered docs returned in January.

MORE: DOJ also says it's urgent that the FBI be permitted to help investigate the empty folders with classification markings to determine what they once held and whether their contents "may have been lost or compromised."

BREAKING - I sense a White Flag being raised here by Cannon, who-to extend the metaphor-may hold her fire on the 100 documents. She is seeing if Trump will just agree to DOJ proposal; she does not have to say she was wrong; and she avoids the embarrassment of losing on appeal.
