When I bring this up some people accuse me of changing my tune about Garland. I have not.
I always understood Garland was investigating J6 when some people claimed he was not. I knew the investigation was going to take a long time because it is the largest investigation in our history. Also Trump was president on J6. He was president when he committed these crimes. That matters.
When Trump was subpoenaed by a Federal Grand Jury for the secret documents, he lied. He obstructed a Federal subpoena and he got caught. Most importantly, when this happened Trump was, is a civilian, period. Trump was a civilian when he obstructed a federal Subpoena. He was a civilian hiding stolen secret documents. That matters.
An ex-president, as far as I know, is not an official government position. He has no special protections when it comes to the law.. Trump committed these crimes as a civilian, that's the difference and it's a big one.
There is no reason it should take months, years to indict Trump the civilian for Obstructing a Federal subpoena. It should happen rather quickly. If Garland is waiting for the elections to be over, that's fine with me.
If the secret document investigation takes years, Trump the civilian is not indicted for obstructing a federal subpoena for years, then I will change my mind about Garland. I don't think that is going to happen.

(13,952 posts)DOJ has that rule to not interfere with elections so I expect the indictment will come in December. Crossing my fingers!

(4,913 posts)He doesn't have to because Trump is not running for office, but Garland wants to look non-political as possible because this is something that will have consequences for the entire nation. Garland is very careful and by the book.

(17,526 posts)National Elections. Or they can't prosecute because Trump is running for President. Or they can't prosecute because Trump was the president. We should, by now, smell the handwriting on the wall.
