It was necessary for her to say that they made a "referral" to deflect attention from the obvious fact that she didn't think they had enough to bring a criminal charge.

that legal action is being taken against a known criminal. It's kind of like when a prosecutor announces they have charged someone with violating the law, as happens daily in America. It's a good thing.
