Trump's 'Special Master' Delay Is Already Backfiring

For years, Donald Trump has managed to tie up lawsuits and investigations by delaying cases and hiding behind the Oval Office desk. His latest ploy is failing miserably.

Former President Donald Trump has learned time and again that the best way to kill legal action is to first delay it. And while Trump’s “special master” gambit initially showed promise in that regard, the tactic may have actually backfired and put him on a fast-track collision course with the federal government he once led.

On Friday, Dearie set an Oct. 28 deadline to know what documents Trump actually wants to hold back from the DOJ on the head-scratching theory that a former president can cite “executive privilege” that somehow supersedes the current executive branch.

In doing so, Dearie is moving significantly faster than the instructions he received to wrap things up by the end of November from the Trump appointee down south who played along with the intended delay tactic, U.S. District Judge Aileen M. Cannon.

Dearie is even bringing in reinforcements. In an order Thursday, Dearie said he’s tapping retired magistrate judge James Orenstein to help sort through the gargantuan mountain of 11,000 documents—and without hesitation ordered Trump to pay him $500 an hour to do it.

.... rule of law, and has no time for Trump and company's delays and bullshit.

* On Friday, Dearie set an Oct. 28 deadline to know what documents Trump actually wants to hold back
because of “executive privilege” knowing full well no longer has executive privilege.

* Dearie is moving significantly faster than the instructions he received to wrap things up by the end of November.
This stops Trump's appointee U.S. District Judge Aileen M. Cannon's delaying tactic.

* Judge Dearie brought in retired magistrate judge James Orenstein and without hesitation ordered Trump to pay
him $500 an hour.

If you say something in his court you better have proof and if ask his court for
something you better be ready to site the case law why the motion should be granted.

Cannon is just a lightweight who is in way over her head.

Imagine if an airline ran this way: We're not sure exactly when your flight to Cancun will take place, but we'll let you know in six weeks when we might schedule it. Or your grocery store: We're probably going to hire some new cashiers in a few weeks. Until then, please wait in line and your groceries will be rung up after they're hired and trained.

I do hope Trump is being required to post a very large retainer, at least.

Oh, and if those documents aren't listed by Oct 28, as if they haven't been holding on to them for over two years already, I just hope Dearie tosses everyone's asses in jail. Including Trump.

Cannon's lack of experience, and understanding of the law, marks her as a judge "in training". She has a lot to learn before she can walk with the likes of Judge Dearie.
Her perceived bias may make it impossible for her to ever get there.

had made some judgements on some FISA warrants issued for members of TFG's inner circle. Since these judgements concerned search and seizure and were favorable to Team Trump, TFG's people thought this guy was on their team.

Judge Dearie is a conservative republican, never forget this fact. He doesn't get a pass for actually doing his job. It's clever to bring in Orenstein, any blame game in the future is now spread out over three judge's.

"As Dearie said the other day, Trump chose to make himself a plaintiff, and in that posture, he may be forced to make affirmative claims he would never be forced to make as a defendant.

Dearie also required that Trump differentiate the documents he claims are Executive Privileged that can be accessed by the Executive from those that cannot."
