First, get to the desired ruling. Then, reverse-engineer that ruling (hell, use citations to 16th century witch hunters if you must) overlooking such quaint legal customs such as standing or deadlines to file objections to FDA rulings on the safety and efficacy of a pharmaceutical drug, and trust your colleagues farther up the judicial chain to uphold your groundless opinion.
