With all the brainiacs in DU, can anyone provide answers to the following questions? Thanks.
Can a State Attorney or District Attorney file Federal charges?
Or can that only be done by a U.S. Attorney?

(932 posts)I think it has to do with jurisdiction and the type of crime. I think they may be able to make referrals if they find federal crimes.

(14,784 posts)charges must be filed by a federal prosecutor.
Bragg can't do shit about federal crimes in regards to them being federal crimes. But sometimes a particular action which happens to break a federal law also breaks a state law of some sort. And in those cases, the state/local prosecutors can file charges for that breakage of state law.

(8,864 posts)I was in a Twitter discussion about a state judge filing federal charges.
After a few back&forth's, I figured out the dumb@$$ was referring to DA Bragg, not a judge.
He's claiming that Bragg has already filed federal charges unconstitutionally.
I haven't seen Bragg even file State charges yet.
