Republican legislation is being passed in Democratic-led Senate

Due to Feinstein's absence, Manchin is the swing vote and he just passed this bill with Republicans.

That's insane to me. What good is controlling the Senate when Republicans still get to pass what they want and block our nominations?

The Congressional Review Act requires federal agencies to provide Congress with a copy of newly created regulations and sets out a expedited procedure for Congress to pass disapproval resolutions rescinding these regulations. In order to pass, disapproval resolutions must receive a majority vote in both the House and Senate and be signed by the President no later than 60 legislative days after being received by Congress.

As part of the expedited procedure, the 30 senators can move the disapproval resolution to the floor, and debate is limited to 10 hours. As such, it cannot be filibustered.

Bush signed one disapproval of a Clinton regulation, Biden signed three disapprovals of a Trump regulation, and Trump signed 16 disapprovals. Trump's disapprovals are actually interesting because only 14 of the regulations were from the Obama administration; he agreed with Congress to undo regulations created by his own administration.

Even with Dianne Feinstein out, there's still 50 of us plus the VP. Besides, Schumer controls what bills are put forward.

The VP only votes to break a tie, if Manchin votes with the 49 Republicans, there is no tie, there is a majority. If DiFi is back, then it's a tie and the VP can vote to break it.

I would guess it's because he does not want to totally alienate Manchin, which is why Joe may not exercise his veto power. If they want Manchins vote on other more important legislation, signing off on small stuff that Manchin supports may be a reasonable quid pro quo.

If Manchin and Sinema decided to caucus with the Republicans, then we lose the senate.

The short answer is that the CRA allows 30 senators to bring a disapproval resolution to the Senate floor and debate is limited to ten hours. After 10 hours of debate, it's a straight up majority vote. It cannot be filibustered.

These are uncalled for attacks on a venerable Democrat who is in recovery from an illness.

No one would stand for such a thing is the bashing was aimed at John Fetterman (nor should we), but it seems only some Democrats are really Democrats here on DU.

The ongoing attacks on Dianne Feinstein are shameful in the extreme.

(Today's forced revision, Democrats somewhat better but not nearly enough.)

Actually, my real question is, why haven't those who do all been shown the virtual door long before this? Sincerely deluded or cynically deceiving, the suppressive effect on votes for Democrats is the same.

Although this situation is unfortunate, there will never be a time when all senators will always be available.

The answer is always, elect ENOUGH Democrats. Btw, New Deal voters turned DC over to the Democrats with a supermajority in the senate. Those people were done complaining.
