Nudity isnt speech. To put it another way, as of Friday in San Francisco, no nudes is good news.
A suit by a group of naked activists challenging an impending city ordinance that bans exposing ones genitals in public was dismissed Tuesday by U.S. District Judge Edward Chen, who said requiring people to wear at least some clothing doesnt violate the First Amendment.
Nudity is not inherently expressive, Chen wrote. The ordinances general ban on public nudity for the most part regulates conduct only.
He left the door open, though, for a future lawsuit if the city should enforce the ban against unclad political protesters in a way that stifles their message. That just might happen once the ordinance takes effect, said the plaintiffs lawyer, Christina DiEdoardo.

(11,417 posts)older gay men I don't think there would be an ordnance in the first place.
Law is in the eye of the beholder.
There are women in Bay to Breakers and the World Nude Bike ride in San Fran and I hear they won't be bothered by the city.
