Family Battles Sex Assault Claim Against 6-Year-Old

HERCULES (CBS 5) – An East Bay dad claims a game of tag on the playground resulted in his 6-year-old son being accused of sexual assault – a decision he said was an overreaction by school officials.

The parent, who asked only to be identified as Oswin, said his son was accused of brushing his best friend’s leg or groin while the two were playing on the playground at Lupine Hills Elementary in Hercules two months ago.

Oswin said his child was kept in the principal’s office for two hours until he confessed. He was suspended, and a sexual battery charge was placed on his permanent school record.

It wasn’t until Oswin and his wife got a lawyer that the school backed off. District officials declined to discuss specifics. They did confirm that an investigation was conducted, and that the child could not be charged with sexual battery. The claim was removed from the boy’s record.

I'm a boy and that person is a girl. And my six year old niece rough houses with her boy friends NOT boyfriend all the time.

there was absolutely nothing sexual. there was a big hole in his back yard and we wanted to see who could pee the farthest across it. boy did we get in trouble when we got caught.

That they should not be held to account for everything they do, because they don't honestly understand the consequences of it.

Kind of sad to see 100 year old ideas look more modern than our current wet dream of vengeance.

If the situation happened as it reads, then it was just a game of tag. Someone saw something in that play situation that they most likely shouldn't have seen ie read something that was not there.

However, I also believe that even 6 year-olds are sexual beings.
I remember being fascinated by the playboy magazine I found at that age.
I remember my sister talking about how her daughter in the crib would masturbate.
I remember my friend Jim telling me that when he was 2 or 3 years old, he knew he was really supposed to be a girl, and that he was going to have his penis removed as soon as he could figure out how.

Again, treating this child as a criminal is crazy, but we do need to acknowledge that although it is innocent, children are sexual creatures.

In the 1980's there was the infamous McMartin Preschool Abuse Trial in California. It lasted years, when the McMartins were obviously innocent. Some misguided and evil adults got 384 former McMartin students to accuse members of the McMartin family of sexual abuse, along with accusations of a number of other bizarre crimes against the kids.

At the time (maybe it still is) it was the longest and most expensive criminal trial in American history.
