"Is the US spying on us foreigners?"

All this talk about "is the US spying on its own citizens...

Well let me toss this out there for you -quoted from a friend's blog:

"...while it appears recent US laws have enshrined, at least theoretically, a legal framework to decide whether a surveillance operation on US citizens may go ahead, there is not even that flimsy theoretical protection for non-US citizens. In other words, foreigners, innocent of any crime, or even suspicion of committing any crime, are fair game to have their data recorded and used at the US government's whim, with no legal recourse. This doesn't strike me as very democratic, if true..."

As a non-citizen the 4th does not cover you.

Even if your communication goes through Mexico, or Canada, which it does, and you are a citizen, you are fair game to have your data recorded and used at the whim of the government.

No wonder some of us are mad, eh? We are all being treated as foreigners!
