racism dead?

This is not an actual discussion, just a point that may have been made elsewhere earlier: does anyone else find it ironic that John Robert wrote, in the majority opinion on the Voting Rights Act, that racism is basically dead in the U.S. while at the same time the state of Florida had to be more or less forced into putting a white man on trial for lynching a black man (child)?

I could be wrong or misstating the facts but I don't think so. Racism is alive and well in all corners of the U.S., including inside John Robert's tiny little mind. All John would have to do would be to turn on the television and tune in to the trial in Tampa to see it in action.
