Worst Supreme Court

I still think that Rehnquist's Supreme Court that decided the outcome of election over the citizens of the United States as the absolutely WORST SUPREME COURT EVER. Mind you this is based on the Majority that rules, not the overall makeup of the group. That was when Rehnquist, Scalia, Thomas, Kennedy and O'Connors decided they would pick the president instead of letting Florida finish the counting. Almost a decade later Sandra Day O'Connor even said it was a bad decision.

I use to think the second worst Supreme Court lead by Roger B. Taney who along with 5 other justices decided the Dred Scott case was the 2nd worst. But I think they have been surpassed by the John Robert's Supreme Court where Roberts, Scalia, Thomas, Kennedy (those 3 from the Rehnquist years) and Alito have to now be in 2nd place with all the Civil Rights they have taken away especially with the Voter Rights Act. Sure Kennedy and Roberts surprise us from time to time and do the right thing but only because the Robert's Supreme Court has to toss a bone to us liberals from time to time so we don't notice all the damage they are doing. BTW this is the same group that gave Citizenship to Corporations.

What other United States Supreme Courts totally sucked??!!

That is the unifying thread of the VRA, Affirmative Action and DOMA opinions. They are supporting state's rights over individual rights. It is a dangerous path they are taking us down.

What I find fascinating, is the fact that they did not say the practice was unconstitutional, but that congress used the wrong metric. They have decided that they oversight over congress and if they do not cary out their duties to the satisfaction of the court, the court has the power of nullification. I find this amazing!

Citizens United is disastrous, eminent domain a few years back. The Voter Right Act repeal, followed by the DOMA decision is baffling.

most of the odious court decisions in our history were more standing in the way of progress than making things worse.

sure, the dred scott decision was odious, but it didn't create slavery -- we already had slavery and its many odious implications.

the trend over the last 30 years (gay marriage, e.g., excepted) is actually a rolling back of progress. they are paving the way for a return of state abuses over the rights of individuals, corporate abuses over the rights of workers, corporate abuses over the rights of minority shareholders, etc.

they are not merely standing in the way of progress, they are actually taking us back to an earlier era that our country rejected.

We think it's a new thing because the Earl Warren Court is still within memory, and it had some great minds who made some of the nation's greatest decisions. We use the Warren Court as a yardstick when measuring today's courts, but it's highly unlikely we'll ever have another court of that caliber.

Whichever court made the decision that corporations are legally people made a disastrous error from which this country might never recover. The Citizen's United decision is on a par with it, although Americans are becoming more educated about that decision and I think we'll eventually see a major effort to pass a Constitutional Amendment to overturn it.

It's taken a lot of wrong turns to get to where we are today. Our Constitution is a great document, but it's flawed in many ways, and much of it is outdated. Any court we have is only going to be as good as the Constitution they interpret. We're eventually going to have to either pass a lot more amendments or draft a new constitution, I'm afraid.
