AUSTIN, Texas -- AUSTIN, Texas (AP) — New abortion restrictions passed by the Texas Legislature are unconstitutional and will not take effect as scheduled on Tuesday, a federal judge has ruled.

District Judge Lee Yeakel wrote Monday that the regulations violated the rights of abortion doctors to do what they think is best for their patients and would unreasonably restrict a woman's access to abortion clinics.

Lawyers for Planned Parenthood and other abortion providers brought the lawsuit, arguing that a requirement that doctors have admitting privileges at a hospital within 30 miles of the abortion clinic would force the closure of a third of the clinics in Texas. They also complained that requiring doctors to follow the Food and Drug Administration's original label for an abortion-inducing drug would deny women the benefit of recent advances in medical science.

The Texas attorney general's office argued that the law protects women and the life of the fetus. Attorney General Greg Abbott was expected to file an emergency appeal of Yeakel's order to the 5th Circuit Court of Appeals in New Orleans.

Unlike the Mississippi case, Yeakel's order is a final decision, setting the groundwork for the 5th Circuit to review the merits of the law, not just an injunction against it.

The proposed restrictions were among the toughest in the nation and gained notoriety when Democratic state Sen. Wendy Davis launched a nearly 13-hour filibuster against them in June. The law also bans abortions at 20 weeks of pregnancy and beginning in October 2014 requires doctors to perform all abortions in surgical facilities.


Take that Rick Perry. Oh and a note to Cruz about Wendy Davis, take a lesson. That was one hell of a filibuster for the health of the Women of Texas!

They are Women's Health Clinics.

I hate when we use Rethuglican terminology. It's like they win when we use their vocabularly to describe things that are important to us that they want to destroy.

ObamaCare is the ACA
Entitlement,is Social Care Services And does not include ss or Medicare

and
Abortion Clinics is Women's Health clincs

I hate when the media adopts rightwing vocab as well

Bastard is still withholding Extended Medicaid for millions of Texans and trying to limit the amount of money spent on preemie births. A normal delivery costs around $2,500 while a baby with care in NICU runs a bill up to $45,000. Seems Texas Rethugs don't want Medicaid paying for it. Some pro-life. Republicans hate women and children.

Will they take revenge? I don't know. But accidents happen. I don't want any judges suffering from vigilantism in this country. Several gun owning people I know -- one from Ohio, one from Florida and one from Texas -- have outright claimed that "activist judges" need killing. They're nobodies, but they claim they're networked. I've told them that they're criminal to advocate such things, but they just laugh at me.

Here's what didn't:

The drug protocol piece which endangers women was challenged but the judge upheld it.

The piece that requires the unnecessary and onerous physical plant requirements to be the same as ambulatory surgical centers wasn't challenged. It goes into effect in 2014 and if not challenged or if challenged and upheld, it will close most TX abortion clinics

the 20 week cutoff date for almost all abortions.

Lots of very bad law still intact.
